Development plan Bergedorf 40 1st amendment Hamburg

Description

Paragraph 2 of the Gesetz über den Bebauungsplan Bergedorf 40 of 2 January 1970 (Hamburgisches Gesetz- und Verordnungsblatt, page 5) is amended as follows: 1.The introductory part is replaced by the following: "The following provisions shall apply to the implementation of the development plan:". 2.The previous provision shall become point 1. 3.The following points 2 and 3 are added: "2. In the core area between the streets of Sachsentor and Hinterm Graben, amusement arcades and similar undertakings within the meaning of Paragraph 33(i) of the Gewerbeordnung, which serve to install gaming machines with or without profit opportunities, as well as sales rooms and sales areas, demonstration and business premises whose purpose is aimed at the sale of articles, representations or acts of a sexual nature, are prohibited. 3. The core area referred to in point 2, for which the Ordinance for the Protection of the Environment Area Sachsentor of 13 June 1978 (Hamburg Law and Ordinance Gazette page 202) applies, is defined as a "conservation area" pursuant to Section 172 of the Building Code. In this area, in order to preserve the urban character of the area due to its urban design, demolition, modification, change of use or construction of structures require a permit, even if a permit is not required under the Building Exemption Ordinance of 5 January 1988 (Hamburgisches Gesetz- und Verordnungsblatt page 1). Permission to demolish, modify or change the use may only be refused if the construction alone or in connection with other constructions characterizes the townscape or the cityscape or is otherwise of urban planning, in particular architectural history significance. Authorisation to construct the structure may be refused only if the urban design of the area is affected by the proposed structure."
