Plant register according to 44. BImSchV
Description
According to § 6 of the forty-fourth Ordinance implementing the Federal Immission Control Act (Ordinance on medium combustion, gas turbine and internal combustion engine plants - 44. BImSchV), the operator of a combustion plant must notify the competent authority in writing or electronically of the intended operation of the combustion plant in accordance with Section 1(1)(1) and (3) of the Ordinance before putting it into service, and must notify the competent authority of the planned operation of the combustion plant in Annex 1 to the 44th Ordinance. information referred to in the BImSchV.
By way of derogation, the operator of an existing combustion plant shall notify the competent authority in writing or electronically of the operation of the combustion plant by 1. 1 December 2023, including those set out in Annex 1 to the 44th information referred to in the BImSchV.
Pursuant to Paragraph 36(1) of the 44th BImSchV, the competent authority shall keep a register with information on each combustion plant to be registered in accordance with Section 6 (plant register). Pursuant to Section 36(4), the competent authority shall make the information contained in the register of installations publicly available, including via the internet, in accordance with the provisions on access to environmental information.
The LBEG complies with this publication obligation by providing the required information on the NIBIS® card server.
