Development plans, project-related development plans (areas)
Description
The scope of all the development plans established and under the procedure, including the project-related development plans, is presented. The specific task of the development plan is to set a binding framework between the land use plan and the approval of a specific project, which still leaves room for the owner’s own design and does not yet anticipate the concrete administrative decision on a given project. It is not regularly its task to narrow the framework to a predetermined project (except for the project-related development plan). The development plan is only required to determine and specify only as far as is necessary for the urban planning order and complies with the requirement of fair consideration (including private interests).
Development planning is an offer planning within the meaning of such a framework, which does not create any direct obligation to act. The establishment of a development plan does not require implementation. It is left to the property owner or the user whether and when he wants to start using it, e.g. build it. However, if he accepts the use, he must comply with the determinations of the development plan.
