Areas with a right of pre-emption, special areas of conservation nature: Overview of the areas in which a right of pre-emption has been established pursuant to Article 37, §1, 2° and 6° of the Decree of 21 October 1997 on nature conservation and the natural environment (Belgian Official Gazette 10/01/1998).Special areas of conservation are areas designated by an EU Member State (including Belgium) for certain habitats and/or species in implementation of the Birds or Habitats Directives.The right of pre-emption within these special areas of conservation is valid:- within the green and forest areas and the forest expansion areas and the areas comparable to all these areas, designated on the basis of the plans of construction or the spatial implementation plans in force in spatial planning;- in the search areas (demarcated in accordance with Article 50septies, §4, first paragraph of the Decree of 21 October 1997 on nature conservation and the natural environment) regardless of the planning destination in the approved plans of construction or spatial implementation plans.
