Description

Preserved landscape features Farmers' payments are conditional on compliance with cross-compliance. The GAEC requirements of cross-compliance include the obligation to preserve landscape features. The requirements of Annex II to Regulation (EU) No 1306/2013 of the European Parliament and of the Council include the maintenance of landscape features. At national level, provisions on the preservation of landscape features are laid down in the Government Decree on the Good Agricultural and Environmental Conditions of Cross-Compliance 4/2015 (as amended). The applicant shall maintain the landscape features inside the agricultural base parcel or on the lower edge of the base parcel or between adjacent base parcels. The preservation of landscape features is controlled under cross-compliance. The landscape features to be preserved under cross-compliance include a tree, group of trees, boulder or similar natural formation (≤ 0.2 ha) designated as a financed natural monument under section 23 of the Nature Conservation Act (1096/1996) or, in Åland, under section 6 of the Provincial Act (ÅFS 82/1998). Landscape features also include large individual trees and groups of trees dominating the open landscape, which is a protected habitat type (≤ 0.2 ha) on the basis of Section 29(1)(9) of the Nature Conservation Act (1096/1996) or Section 5(8) of the Åland Provincial Decree on Nature Conservation (ÅFS 113/1998). Decisions on the protection of natural monuments are made by municipal environmental authorities. The Centres for Economic Development, Transport and the Environment (ELY Centres) are responsible for the protection of individual trees and groups of trees in accordance with the Nature Conservation Act. In Åland, the Provincial Government is responsible for the protection of natural monuments and habitats. Declaring a landscape feature in an eligible area Depending on the landscape feature, you can report the eligible area using form 442 (https://www.ruokavirasto.fi/globalassets/information-us/services/guides-and-forms/farmers/supports-and-financing/forms/442.pdf). Landscape features can be accepted as eligible area for all area-based payments to farmers (e.g. basic payment, environmental payment). Landscape features up to 0,2 ha may be considered eligible. Protected areas larger than 0.2 hectares and areas not covered by a lease, for example, are not eligible for aid. Landscape features may be accepted for the total area of a base parcel if they are located within the field parcel, on the margin of the field parcel or between adjacent field parcels. The area of the landscape feature shall become part of the eligible area of the base parcel only in the year following the submission of the declaration. The area of the landscape feature is associated with the parcel of land in the immediate vicinity of the site. In the parcel-specific notes, the farmer makes the landscape feature his own fertilisation parcel, on which no fertilizers may be applied.
