Development plan Bergedorf 35 1st amendment Hamburg

Description

The following provisions are added to Section 2 of the Bergedorf 35 Development Plan Act of 2 October 1975 (Hamburg Law and Ordinance Gazette, page 176): "4. In the core areas north of Bergedorfer Straße, with the exception of parcel 4009, amusement arcades and similar undertakings within the meaning of Paragraph 33(i) of the Gewerbeordnung, which are used for the installation of gaming machines with or without profit opportunities, as well as sales rooms and sales areas, showrooms and business premises whose purpose is aimed at the sale of articles, representations or acts of a sexual nature, are prohibited. 5. Core areas in which the Ordinance for the Protection of the Environment Area Sachsentor of 13 June 1978 (Hamburg Law and Ordinance Gazette page 202) applies are defined as "conservation area" according to § 172 of the Building Code. In this area, in order to preserve the urban character of the area due to its urban design, demolition, modification, change of use or construction of structures require a permit, even if a permit is not required under the Building Exemption Ordinance of 5 January 1988 (Hamburgisches Gesetz- und Verordnungsblatt page 1). Permission to demolish, modify or change the use may only be refused if the construction alone or in connection with other constructions characterizes the townscape or the cityscape or is otherwise of urban planning, in particular architectural history significance. Authorisation to construct the structure may be refused only if the urban design of the area is affected by the proposed structure."
