Description

The law on the Eidelstedt 30 development plan of 25 June 1997 (HmbGVBl. p. 289), as amended on 1. December 1997 (HmbGVBl. p. 524), is amended as follows: 1.Annex to the Regulation amending the Law on the Eidelstedt 30" development plan Law added. 2.In § 2, the following point 9 is added: "9. The following applies to the area of amendment to the Eidelstedt 30 development plan shown in the annex: 9.1 Retail establishments are prohibited in the mixed area. By way of exception, retail uses are permitted which have a direct spatial and operational connection with craft or manufacturing businesses and whose area does not exceed 20 per cent of the area covered by company buildings. 9.2 Along the Rungwisch, the living and sleeping rooms are to be assigned to the noise-repellent sides of the building by arrangement of the building structures or by suitable floor plan design. If it is not possible to arrange all living and sleeping rooms of an apartment on the side of the building away from noise, the sleeping rooms must primarily be assigned to the side of the building away from noise. For the rooms on the noise-facing sides of the building, sufficient sound insulation must be provided by structural measures on external doors, windows, external walls and roofs of the buildings. Living rooms in one-room apartments and children's rooms are to be judged as bedrooms. 9.3 Recreation rooms of commercial use, in particular the break and rest rooms, are to be assigned to the noise-removed sides of the building by means of suitable floor plans. Insofar as it is not possible to arrange it on the sides of the building away from traffic noise, adequate sound insulation must be provided for these rooms on external doors, windows, external walls and roofs of the buildings by means of structural measures. 9.4 By way of derogation from point 3, the following definition shall apply to the mixed area north of the Rungwisch: Along the Holsteiner Chaussee, sleeping rooms are to be orientated towards the noise-repellent side of the building. Living rooms in one-room apartments and children's rooms are to be judged as bedrooms. If a level of 70 dB(A) per day is reached or exceeded on the sides of the building, structural sound insulation measures in the form of glazed porches (e.g. glazed loggias, conservatories) or similar measures shall be provided for on the windows of the rooms oriented towards this side of the building. For an outdoor area of a dwelling, it shall be ensured either by orientation on noise-repellent sides of the building or by structural sound insulation measures, such as glazed loggias with partially open components, that these structural measures achieve an overall noise level reduction that makes it possible to achieve a day level of less than 65 dB(A) in the outdoor area associated with the dwelling."
