Description
Through legally regulated procedures for real estate reorganization
With the instruments described in the Building Code (BauGB), reallocation, simplified reallocation, urban development measures as well as the land reorganisation regulated in the Land Consolidation Act (FlurbG), land can be rearranged by changing land boundaries and replacing land areas.
In the reallocation (§§ 45 - 79 BauGB) private and public building plots, paths and open spaces are formed on a large scale. Ownership of the existing land is transferred to newly formed building plots. This redesign and reorganization of the land corresponds to a legally regulated land exchange.
By means of simplified reallocation (§§ 80 - 84 BauGB), directly adjacent or closely adjacent plots of land can be exchanged with each other or parts of the plot can be allocated unilaterally.
The urban development measure (§§ 165 - 171 BauGB) as an overall measure is intended to speed up the development of the city within the framework of a procedure aimed at immediate implementation. It allows the municipality to acquire land on an interim basis if the planning and development objectives cannot be achieved otherwise. In order to achieve these goals, the newly arranged building plots will be sold to those willing to build, primarily to the former owners.
