**Eindhoven open data principles**
A. Data in public space (further: “data”) belong to everyone. These data are public good. Data collected, generated or measured (e.g. by sensors placed in the public space) should be opened up so that everyone can use it for commercial and non-commercial purposes. In doing so, a privacy and security balance must be made.
B. Data may contain personal data. This data can therefore affect the privacy of individuals. The rules of the Data Protection Act apply to this. This data should only be opened after the data has been processed (e.g. anonymised or aggregated) in such a way that there are no longer any privacy risks.
C. Data that does involve privacy or security risks may only be processed within the framework of privacy legislation. Storage and processing of data must be carried out in accordance with existing legislation.
D. Data that does not (any longer) contain personal data should be placed in such a way that everyone can access that data in an equivalent manner (e.g. through an Open Data Portal). This is called the opening of data. No technical or legal barriers are created that prevent, restrict or discriminate against access to data.
e. Data will always be opened free of charge, without unnecessary processing (where possible in the raw form) and according to functional and technical requirements to be determined.
F. Discrimination is made with personal data (such as an e-mail address or payment details) which are collected with conscious knowledge and after explicit consent of persons. Use of this data is determined through an agreement between affected parties within the framework of the privacy legislation (such as a user agreement).
G. Gemeente always has insight into which data is collected in the public space, regardless of whether or not the data can be open.
h. Municipality remains in dialogue with the parties that contribute to the data infrastructure in the city and strives to create earning opportunities and a fruitful economic climate.
