Contaminated areas according to DüV from 2023 – Contaminated areas

Description

In the implementation of the Fertiliser Ordinance (DÜV) and the Land Fertiliser Ordinance of Rhineland-Palatinate, the groundwater bodies designated under the EU Water Framework Directive (WFD) in addition to the nitrate concentrations at groundwater measuring stations are the basis for the designation of so-called “red” or nitrate contaminated areas. Agricultural practice pays great attention to the identification measuring network underlying this. With the amendment of the General Administrative Regulation of the Federal Government for the designation of nitrate contaminated and eutrophicated areas of August 2022, the Fertiliser Ordinance amended in April 2020 and the revision of the Land Fertiliser Ordinance in autumn 2022, the classification of the polluted areas from 2023 will be based on other criteria, namely instead of a small-scale differentiated calculation of the nitrate yields in conjunction with the site-specific compatibility for nitrate inputs only on the basis of nitrate concentrations of 341 groundwater measuring points of the designation measuring network in Rhineland-Palatinate (as of the end of 2021). Due to the nationwide requirements, the designation must be independent of the land use. All parcels, e.g. also dirt roads with at least 20 % of their area in areas calculated as polluted, are completely included.
