Administrative law; procedures at the CRvB, 1998-2016
Description
This table contains details of (higher) appeal procedures submitted, completed and pending in administrative jurisdiction before the Central Appeals Board. The data are broken down by type of regulation.
An appeal to the administrative court is brought against a decision of an administrative body, such as a ministry, a municipality, a social service, etc. Administrative justice is largely carried out by the courts at first instance.
The judgments of the courts may be challenged on appeal before the Central Appeals Board.
This table gives an overview of the number of proceedings brought before the Central Board of Appeal, their progress over a year and the way in which these proceedings are settled.
It lists (higher) appeals and requests for interim relief as separate procedures.
The classification by regulation is based on the law or regulation on which the contested decision of the administrative body was based.
This table contains stock figures measured at 1 January and 31 December. This table also contains information on the number of cases submitted and/or completed in a reporting year (flow figures). The figures on 31 December of one year and 1 January of the following year do not always correspond. An appeal may be lodged against a judgment under simplified procedure. Calculation of the stock figure at 31 December from the stand rate on 1 January and the flow figures do not always lead to the published figure. This is the case if, in one year, a decision under simplified treatment has been taken several times in the same case, followed by an appeal. Of such a situation, only one is counted in the flow figures.
For each reporting year, all cases are selected from the registrations of the courts for which an action or decision falls within the selection period. All information of a case is selected, even if this information had already been provided. The information provided contains changes for years already published. As a result, the figures on 31 December of the previous year and 1 January of the year under review do not always match each other.
