Scope of Consideration (PPC) on Rennes Métropole
Description
This layer of polygons lists the scope of consideration (PCC) on Rennes Métropole. The principle of a Consider Perimeter (PPC) and a Statuer Sursis Perimeter (PSS) is as follows: For the purposes of Article L.424-1 of the Urbanisation Code, consideration is given to a project for urban development or renewal, for example, in an area of the territory, and it is specified that a stay of proceedings may be imposed on that area on any application for permission to construct which could jeopardise that operation (for a period of 10 years if the operation is not initiated by that time). The concept of PPC and SSP is linked. This is why in the automated urban planning information developed by Rennes Métropole (in the AUCs), we display the following standard sentence when the case arises: “Land concerned by a scope of consideration (with possibility of stand-out)”. Where works, constructions or installations are liable to jeopardise or render more expensive the carrying out of a development operation within the scope of operations in the national interest, the stay of proceedings may be suspended, under the conditions laid down in Article L. 424-1, provided that the study of the development project has been taken into consideration by the competent administrative authority of the State and the land affected by that project has been delimited’. The decision to take into account shall cease to have effect if, within ten years of its entry into force, the implementation of the development operation has not been initiated. The decision to take into account (PCC) is established by the developer of the project taken into consideration (deliberative assembly for local authorities, prefect for the State), by deliberation of the municipal council or of the deliberative body of the EPCI or by a decision of the administrative authority (i.e. the developer of the project) which takes into account the already defined development project, or the studies that are launched and which will enable it to be defined. This deliberation must delimit the land concerned. The plan accompanying the decision must be sufficiently precise to enable the parcels concerned to be identified (EC, 12 Nov. 2007, Minister for Equipment, No 281345). In order to be enforceable against an application for planning permission, the deliberation of “taking into consideration” must have been published (posted in town hall for one month, publication in a newspaper and transmission to prefecture) before the application was submitted.
