Nitrate contaminated areas according to § 13a DüV (01/2024) and affected field blocks (as of 09/2023) within the nitrate contaminated areas pursuant to § 13a DüV (01/2024)

Description

In accordance with Section 13a of the DüV, more stringent requirements for fertilisation for groundwater protection reasons exist on the agricultural land located within the nitrate-polluted areas. The measures are necessary in order to achieve the objectives set out in the EC Water Framework Directive and the Nitrates Directive with regard to the nitrate pollution of groundwater and to meet them in the long term. The designation of these “red areas” as of 01/2024 was carried out by the LANUV NRW in accordance with the requirements of the General Administrative Regulation for the designation of nitrate-polluted and eutrophicated areas (AVV GeA) of 10.8.2022. The basis for the designation is the groundwater measuring points of the designation network according to § 4 AVV GeA. This measuring network includes all measuring points of the WFD Quality (WRRL) and EUA/nitrate measuring network, provided that they meet the requirements of Appendix 1 AVV GeA. According to Sections 3 and 5 of the AVV GeA, when determining the nitrate concentrations in areas where denitrifying conditions (nitrate degradation) are present in groundwater, in accordance with Appendix 2 of the Groundwater Ordinance (GrwV), the nitrate content in the groundwater before denitrification must be calculated in accordance with the best available methodology. This value must be taken into account accordingly – if higher – instead of the nitrate concentration. The starting points for the designation are the groundwater bodies according to the EC Water Framework Directive of the third status and trend assessment, in which a nitrate load or a persistently increasing nitrate trend currently exists (data base WFD measuring points of the 3. Monitoring cycle 2013-2018). In addition, groundwater bodies (CHPs) must be taken into account, within which a measuring point of the designation measuring network with agricultural use influence exceeds the nitrate threshold or an increasing nitrate trend or, taking into account denitrification (see above), exceeds the nitrate threshold. In the next step, a delimitation between polluted and unencumbered sub-areas (immission-based delimitation) takes place within these affected CHPs. In addition to the nitrate concentrations (2016-2019) measured at the measuring points of the designation network, hydrogeological, hydraulic or hydrogeological and hydraulic criteria based on groundwater equal maps, a modeled groundwater surface of the country, and hydrogeological maps are used. The polluted sub-areas thus demarcated are designated as nitrate-polluted areas in accordance with § 13a DüV. If a share of at least 20 percent of a reference agricultural parcel (in NRW: Field block) located within a polluted area, according to § 7 AVV GeA, their total area is attributed to the nitrate contaminated areas.
